5 MLAs’ nomination to J&K Assembly: Final hearing postponed, scheduled for Feb 6

Jammu, Dec 18: The final hearing scheduled for December 18, 2025, regarding the nomination of five MLAs to the Jammu and Kashmir Assembly, could not take place as the Solicitor General, Tushar Mehta, was unable to attend the court proceedings due to certain reasons. “The final hearing regarding the nomination of 5 MLAs to the J&K Assembly was adjourned today at the request of the senior counsel for the Union of India,” Ravinder Sharma, Chief Spokesperson of Jammu and Kashmir Pradesh Congress Committee (JKPCC), told Rising Kashmir. The court has now listed the final hearing on the case for February 6, 2026, according to Sharma. The hearing was scheduled before the Divisional Bench of Justice Sanjeev Kumar and Justice Rajesh Sekhri in Srinagar. When the matter was taken up on Thursday, the court informed the petitioner, Ravinder Sharma, that there was a request for adjournment from the other side, as Tushar Mehta, Solicitor General, was not available. It is noteworthy that the political landscape in Jammu and Kashmir, including the Assembly's strength, is likely to undergo significant changes following the final court decision on the nomination of the five MLAs. The Public Interest Litigation (PIL) was filed over a year ago by J&K Congress Chief Ravinder Sharma. A team of prominent Congress lawyers, along with the Government of India (GoI) and the office of the Lieutenant Governor (LG) of J&K, have submitted their replies in court concerning the matter. While the GoI and LG’s office have stated that the nomination of the five MLAs is the sole prerogative of the LG, the Congress has argued that the nomination process should be under the purview of the elected government. Leading the Congress legal team is Abhishek Manu Singhvi. Ravinder Sharma said, “We have a strong case based on the violation of the basic structure of the Indian Constitution.”
