Srinagar, Dec 01: The High Court of Jammu & Kashmir and Ladakh Wednesday sought personal appearance of Chief Engineer, Public Health Engineering (PHE), Kashmir, Srinagar along with the Executive Engineers of Water Works Division, Srinagar and Rural Water Supply Division, Ganderbal today.
"In the event, the officers fail to appear before the Court on the next date, there shall be no option available but to issue bailable warrants for seeking their appearance," a court of Justice Ali Mohammad Magrey directed.
Justice Magrey passed the direction in a contempt plea filed by one, Ghulam Mustafa Sheikh, seeking the release of his salary in tune with the directions passed by the Court on September 29, 2018.
The plea stated that despite court directives, the petitioner’s salary is not being released on the pretext that the service book of the petitioner from the office where the petitioner was working earlier is yet to be transferred by the concerned authorities to the Rural Water Supply Division Ganderbal.
It is stated that the petitioner was transferred to the Rural Water Supply Division Ganderbal in the year 2001 and before that, the petitioner was working in the office of Executive Engineer Water Works Division Ganderbal, wherefrom he was relieved in terms of the communication dated August 8, 2001.
It is further submitted that the salary of the petitioner was released up to April 2017 on minimum grade and thereafter, his salary is withheld with no cause or justification.
The court after perusing the matter said that in order to settle the matter for ensuring the release of salary in favour of the petitioner in tune with the directions passed by it, the Chief Engineer, Public Health Engineering, Kashmir, Srinagar, along with the concerned authorities shall appear before it on the next date of hearing.
The court will hear the matter on December 02, 2021.
